By purchasing services from New Earth Web Design & Marketing, you are agreeing to the following terms and conditions;
Payments
When purchasing a custom website design, logo or any other graphic work, an initial payment of 50% is due before work will begin on your project. The remaining 50% plus any additional agreed upon charges will be due at the time of completion. All payments are non-refundable upon receipt.
Access to your accounts
Each client agrees to allow New Earth Web Design & Marketing access to any hosting or domain accounts needed. The client will also provide New Earth Web Design & Marketing any usernames and passwords to these accounts for the sole purpose of installing, updating or upgrading these services.
Completion Time
New Earth Web Design & Marketing and the client must create an ongoing professional relationship to complete the project within the quoted timeframe. The client agrees to submit all requested information in a timely manner so the project can move forward as scheduled. If requested information is not supplied to New Earth Web Design & Marketing within 30 days of the request, this contract is void and any deposits and payments will be forfeited. New Earth Web Design & Marketing agrees to work expeditiously to complete the project no later than 45 days after the client has submitted all requested information.
Delivery of Project
The final project will be installed on the client’s hosting service. Final payment is due once the project is complete and BEFORE the client’s phone tutorial. All usernames and passwords will be turned over (where applies) after final payment is received. Hosting services are NOT included in any package, unless specified. The client is solely responsible for any and all hosting service charges.
Credit and Use of Products
Our copyright and credit information must remain on all of our products. We require that the text link back to newearth123.com remain in place and in working order. All preliminary proofs to include graphics, layouts, etc, which are not selected by the client remain the full property of New Earth Web Design & Marketing and may be used in future projects for other clients.
Usage Policy
The client agrees that any and all work done by New Earth Web Design & Marketing is NOT to by used by anyone else. This includes any coding, graphics, layouts, proofs or mockups. All graphics and layouts are to be kept whole as given to you. New Earth Web Design & Marketing retains the right to display any projects in portfolios and as advertising material.
Support and Communications
New Earth Web Design & Marketing agrees to provide e-mail only support for up to 30 days after project completion. Please use this time to become familiar with how your website functions and ask any questions. After 30 days there may be an hourly charge for support services depending on the frequency and complexity of the support needed. Phone support is NOT included.
Copyrights and Trademarks
The client agrees that any information supplied to New Earth Web Design & Marketing to be included in the project are owned by the client, or the client has permission from the rightful owner to use the information. Information includes but is not limited to photos, elements of text, trademarks, artwork, graphic.
Confidentiality
All correspondence and documents between New Earth Web Design & Marketing and the client will be treated as confidential.
